Terms and Conditions in plain words

1Acceptance and age

By accessing, browsing or using TuPCGamer, its simulators, guides and compatibility tools, you accept these Terms and our Privacy Policy. If you don't agree, don't use the site. You must be at least 13; if you're under 18, use it with permission from a parent or guardian.

2What TuPCGamer is (and isn't)

TuPCGamer is an independent digital educational initiative about personal computer architecture (gaming PCs and workstations), performance-per-dollar analysis and physical and electrical compatibility checks, for consumers in the United States and the English- and Spanish-speaking community worldwide.

It is an independent, free website governed by the laws of the State of California (US) and funded by ads and affiliate links; its main audience is in the United States. It has no offices or in-person service.

TuPCGamer is not a store and does not sell parts. We don't process payments for parts, manage inventory or ship anything. Purchases, warranties, returns and technical support are the responsibility of the store or the manufacturer.

3Guidance tools

The Configurator, Budgets, Full Setup and the power draw (wattage) estimator use manufacturers' public specifications (AMD, Intel, NVIDIA, ASUS, MSI, Gigabyte, Corsair, etc.) and independent test data:

• For guidance only: alerts about sockets, chipsets, case clearance, thermal capacity (TDP) and power supply wattage are a preliminary analysis.
• Your duty to check: before spending, review manuals, memory qualified vendor lists (QVL) and firmware versions.
• Builds by use (gaming, streaming and local AI): these are guidance-only recommendations. AI performance depends on the models, the video memory (VRAM) they take up and the software; streaming performance depends on the platform and encoding settings. The Budgets performance charts compare the PCs with each other and are estimates, not lab tests.
• “PC + Setup” total, copied list and PDF: they are calculated with the reference prices shown on the site and are not a quote or an offer to sell.
• BIOS and board revisions: some new processors need an updated BIOS on boards with older chipsets. Check with the store whether the unit ships with the required version.
• Not professional advice: the information is general and educational; it doesn't replace the advice of a technician, the manufacturer or the store.

4Assembly guides and safety

The guides are educational. Building or modifying a PC carries risks for the equipment and for you; if you don't feel confident, ask a technician for help.

TuPCGamer is not liable for damage to hardware or people while handling or assembling it (for example, electrostatic discharge, bent pins, excessive cooler pressure, liquid leaks or faulty power supply connections).

5Prices and availability

• Currency and source: all amounts are in US dollars (USD). They reflect the manufacturer's suggested retail price (MSRP) and periodic sampling at US retailers (such as Amazon.com, Newegg, Best Buy, Micro Center and B&H Photo Video). The site shows the dates when they were checked.
• Monitors and peripherals (Full Setup): prices from US retailers (such as Newegg) and each manufacturer's official store, at the regular price, without coupons or discount codes. When a module offers several options of the same type, the total counts the cheapest one; the streaming kit is optional and isn't added.
• Monthly review: we check prices by hand once a month, and the site shows the date of the last check. Between checks they aren't the exact price: they go up or down with demand, deals, stock and imports. The parts that change the most are graphics cards, RAM and SSDs (the last two because of the global memory chip shortage), so the difference can be larger for them.
• Price and stock changes: we don't guarantee that a third party's price will hold or that there will be stock. The valid price is the one the store shows at checkout.
• Buyers outside the US: prices don't include local taxes (VAT), customs duties or international shipping.
• Local currency and import cost: in some countries the site converts the price to your currency with a public exchange rate of the day (in Argentina, the card dollar rate) and estimates courier shipping and import taxes with general rules. These are rough figures, not a quote: the store, the courier and your country's customs set the final amount. Buying abroad and importing it is at your own risk, including delays, customs holds and warranty.

6Ads, stores and affiliate links

Store buttons lead to third-party sites. We don't control their prices, stock, shipping, warranties or policies, and any purchase is an agreement between you and the store.

Affiliate links. Some of those links are affiliate links: if you buy through them, the store may pay TuPCGamer a commission, at no extra cost to you. As an Amazon Associate, TuPCGamer earns from qualifying purchases. We disclose it on the site, for example in each product's sheet, as the US Federal Trade Commission guides require (FTC, 16 CFR Part 255).

Ads. The site shows Google AdSense ads. Google chooses them, not us, and they're kept apart from the content: a product appearing in an ad doesn't mean we recommend it, and we're not responsible for the ads or for what advertisers offer. How they use your data is explained in the Privacy Policy.

Our recommendations are based only on performance, reliability and value, never on commissions or advertisers.

7Permitted and prohibited use

You may: use the tools, copy your list, print or save your PDF and share links to any page.

You may not:

• Automatically or massively copy (scrape) the parts database, prices, guides or illustrations to republish or sell them.
• Use the site for illegal or deceptive activities, or impersonate TuPCGamer.
• Try to harm it: attacks, overloading, malicious code or bypassing security measures.
• Click on ads artificially, repeatedly or automatically, or ask others to do so.

We may limit access for anyone who breaks these rules.

8Intellectual property, trademarks and copyright

TuPCGamer's code, design, databases, calculation algorithms, guide illustrations and texts are protected by US copyright law and international treaties.

Trademarks, logos, model names (for example, GeForce RTX™, AMD Ryzen™, Radeon™, Intel® Core™ Ultra) and product images belong to their owners and are used only to identify products, for educational and comparison purposes (nominative use and fair use). Their use doesn't imply sponsorship by or affiliation with those brands.

Copyright notices. If you believe in good faith that something published on TuPCGamer (for example, an image) infringes your copyright, email contacto@tupcgamer.com with the subject “Copyright” and include:

1. Your physical or electronic signature.
2. The copyrighted work you believe is infringed.
3. The material you consider infringing and its exact URL.
4. Your contact details (at least your name and an email).
5. A statement that you believe in good faith the use is not authorized.
6. A statement, under penalty of perjury, that the information is accurate and that you're the owner or authorized to act on their behalf.

We review every notice and, where appropriate, remove or change the content as soon as possible. If you think we removed something by mistake, write to us and we'll review it again.

9No warranties (“as is”)

TO THE FULLEST EXTENT PERMITTED BY LAW, the site, its simulators and its recommendations are provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose or freedom from errors.

In particular, we don't guarantee that specifications, compatibility, power draw calculations, prices, currency conversions, shipping and import tax estimates, availability or links are accurate, complete or up to date, or that the site will work without interruptions, be secure or be free of errors or viruses.

10Disclaimer of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TUPCGAMER WILL NOT BE LIABLE FOR ANY DAMAGE OR LOSS OF ANY KIND ARISING FROM THE USE OF, OR INABILITY TO USE, THE SITE, ITS TOOLS OR ITS INFORMATION. YOU USE THE SITE AT YOUR OWN RISK.

• Your decisions and purchases: you choose and you buy. You're responsible for what you buy at outside stores and for confirming final physical and electrical compatibility with the manufacturer and the store.
• Assembly and equipment: we're not liable for damage to your equipment, data loss or injuries while handling, assembling, upgrading or using your PC.
• Information: we're not liable for errors, omissions or outdated data in specifications, compatibility, power draw, performance or prices.
• Third parties: we're not liable for stores, manufacturers, advertisers, affiliate programs, providers (such as Google or Vercel) or linked sites, or for their products, prices, shipping, warranties, ads, content or policies.
• No damages of any kind: this includes direct, indirect, incidental, special, consequential or punitive damages, and loss of data, profits or opportunities, even if we were told they could happen.
• No amount payable: because the site is free, TuPCGamer will pay no amount for claims related to it, except to the extent the applicable law doesn't allow this exclusion.
• Indemnity: you agree to hold TuPCGamer harmless from claims, damages and expenses (including reasonable attorneys' fees) arising from your misuse of the site or your breach of these Terms.

Some states and countries don't allow excluding certain warranties or limiting some damages (for example, those caused by fraud or gross negligence). In that case, these exclusions apply only to the fullest extent the law allows, and nothing above takes away rights your law doesn't allow you to waive.

11Changes to the site and these terms

We may change, improve or remove tools and content. We may update these Terms to reflect new tools or legal changes. The date at the top shows the version in force; if a change is important, we'll announce it on the site. Continuing to use the site after a change means you accept the new version.

12Governing law, disputes and language

These Terms are governed by the laws of the United States of America and the State of California, without regard to its conflict-of-law rules.

Before any claim, write to us: we'll try to resolve it in good faith within 30 days. If that's not possible, the parties submit to the competent courts of the State of California, without prejudice to your right to use a small claims court. Nothing here takes away rights that your state's or country's law doesn't allow you to waive.

We publish these Terms in English and Spanish. If the two versions differ, the English version prevails.
